Under the FTCA (The Federal Tort Claims Act), the government can only be sued "under circumstances where the United States, if a private person, would be liable to the claimant in accordance with the law of the place where the act or omission occured." Translated, this means that the government cannot be sued for things they did as a government; in this case, covering up UFOs.
